Waiver of Liability Relating to Coronavirus/COVID-19 The Novel Coronavirus
COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death. Folksy Scouts Inc cannot prevent you [or your child(ren)] from becoming exposed to, contracting, or spreading COVID-19 while utilizing Folksy Scout’s services or premises. It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize Folksy Scout Inc’s services and/or enter onto Folksy Scout Inc’s premises you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19. ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children in order to utilize Folksy Scout Inc’s services and enter Folksy Scout Inc’s premises. These services are of such value to me[and/or to my children,] that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize Folksy Scout Inc’s services and premises in person. WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against Folksy Scout Inc. and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing Folksy Scout Inc’s services and premises. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen. CHOICE OF LAW: I understand and agree that the law of the State of New York will apply to this contract.
Risk Liability Waiver & Release(Required) I agree to the privacy policy.
Assumption of Risk Liability Waiver & Release
On behalf of my minor child, I hereby give permission for my child to participate in Folksy Camp (FC). I hereby warrant that both myself and my child are familiar with the risks associated with participation in FC activities. I acknowledge that my child’s participation in this program is wholly voluntary. I do hereby agree and consent to my child’s participation in the FC program during this school year and do assume all risks and hazards which are conducted as part of the associated activities. I hereby release, absolve, indemnify, and hold blameless FC, Folksy Scouts, Inc., its officers, directors, employees, contracted employees, independent contractors, instructors, agents, organizers, and volunteers of any and all liability for damage, injury, or expense of any kind arising out of or connected with my child’s participation in FC. I understand that in case of a medical emergency, my own personal medical plan will be used if available; if not, medical aid may be sought while I am being contacted. In the event of any illness or injury, I hereby consent to whatever examination, diagnosis, or treatment and the hospital care from a licensed dentist, physician, and/or surgeon as deemed necessary for my child’s safety and welfare. I understand that the resulting expenses will be my responsibility and not the Folksy Scouts, Inc’s or FC’s, or any affiliates. As a condition of participation in the FC program by the student named in this application, I acknowledge that I have read this consent form, and knowingly, on behalf of my child, assume all of the risks associated with participating in any way in the FC program. As consideration for being permitted to participate in the scouts program, I hereby agree that I, my assignees, heirs, distributees, guardians, and legal representatives will not make claim against, sue or attach the property of Folksy Scouts, Inc., or their Affiliates or the supplier of any of the equipment used in these activities for injury or damage resulting from negligence, failure of care, omission or other acts, howsoever caused by an employee, agent or contractor of Folksy Scouts, Inc. and any affiliate as result of incidental to my child participation in these activities. I hereby release, to the fullest extend permitted by law, Folksy Scouts, Inc. and the affiliates, from any and all actions, claims, demands, or liabilities that I, my assignees, heirs, distributes, guardians, and legal representatives now have or may hereafter have for injury or damage resulting from my son/daughter’s participation in these activities irrespective of whether the same is based on breach of warranty, negligence, strict liability or any other theory or recovery. Parent/Legal Guardian acknowledges that FC is an enrichment program and not a licensed childcare or daycare facility.
Participation Agreement(Required) I agree to the participation policy.
The Folksy Scouts Foundations cover a wide range of topics and activities. Foundational lessons include outdoor exploration, fire starting, knife work, working around a stove, etc which require children to be able to follow directions and work independently at times. Troop leaders will work to support each child to ensure a successful experience at Folksy Scouts. We are open and accepting of all children and will do our best to meet the needs of all children participating, however the organization reserves the right to cancel membership if a child is not ready or willing to participate safely in the program. Our curriculum and Folksy Pledge inherently supports empowerment, teaches judgement, honors boundaries, values intuition, increases awareness, models clear communication and encourages healthy expression of all feelings. The organization will make attempts to remedy any issues by means of 1:1 communication and redirection with the child during meetings and behavior planning with parent/guardian, as well as discussion of any incidents with the Assistant Director and Director prior to dismissal.
